Is poker legal in India in 2026? The answer depends on whether you mean social poker or poker played for money. India has a state-by-state gambling-law history, but a nationwide law now prohibits online money games, including skill-based ones, from 1 May 2026. Older state-license advice may now be outdated.
The state-by-state picture
Gambling has traditionally been regulated mainly through state laws. The Public Gambling Act, 1867 provided an early framework, but its Section 3 (common gaming houses) and Section 4 (players found gaming) do not settle modern online poker questions.
Historically, different states approached games of skill differently:
- Nagaland: Its 2016 online games of skill legislation created a licensing framework, which is not an exemption from the later nationwide online money-game prohibition.
- Telangana: Amendments in 2017 tightened rules for online gaming for money, expressly covering games involving skill.
- Andhra Pradesh: Amendments in 2020 expanded restrictions on online gaming and electronic gambling.
- Other states: Rules for physical card rooms, private games, and non-monetary play can differ.
The decisive national change: Parliament enacted the Promotion and Regulation of Online Gaming Act, 2025. The Online Gaming Rules, 2026 took effect on 1 May 2026 per the government’s official announcement, bringing the prohibition framework into operation. The Act prohibits online money gaming services and related advertising and financial facilitation. It covers money games based on skill, chance, or both. For the Act’s own commencement notification, consult the official gazette.
An older state-level skill-game license is not permission to offer a prohibited online money game in 2026. Read the central law and applicable state rules together.
Skill game vs game of chance: why the distinction matters
A game of skill is one where a player’s decisions, knowledge, or practice materially influence results. A game of chance depends more heavily on unpredictable events. Poker combines card randomness with choices about betting, probabilities, and opponents.
Indian courts have long discussed whether skill predominates over chance. In State of Andhra Pradesh v. K. Satyanarayana (1967), the Supreme Court described rummy as mainly a game of skill. That decision concerned rummy, not an automatic nationwide ruling that every poker format is lawful.
Some legal arguments have treated particular poker formats as skill games; others took restrictive approaches. Format and jurisdiction matter.
For online money games, however, the 2025 national Act changes the analysis. Its prohibition does not turn on whether players can demonstrate skill. A game played without money or other stakes is a different category from one where users deposit funds hoping to win.
Playing online: what to check before you sign up
In 2026, start by asking what the game actually requires from you.
- Check the stakes: If you must pay money or another stake with the expectation of monetary gain, examine the nationwide online money-game prohibition before proceeding.
- Check the category: A free social poker game is not the same thing as an online money game. Look for cash prizes, convertible rewards, compulsory deposits, and hidden payment conditions.
- Check any registration claims: Registration for a social game, an older state skill-game license, or an overseas license does not override Indian law.
- Check payments: The national framework restricts payment facilitation of prohibited online money games. A displayed UPI option does not establish that a game is lawful.
- Check your state: State gambling rules still matter for physical venues and local activities. Do not assume a rule from one state applies elsewhere.
- Check official updates: Consult government publications rather than old app-store descriptions or influencer claims.
- Separate online from offline: The Act regulates online gaming. Land-based card rooms in states that license them, such as Goa, Daman and Sikkim, operate under state laws. Free-to-play poker with no deposits and no cash prizes is a permitted online social game.

Taxes: what you owe on winnings
For tax year 2026-27, check the Income-tax Act, 2025 and the Income-tax Rules, 2026. Earlier tax years remain subject to the applicable transitional provisions under the 1961 Act.
The 2026 Rules introduced new mechanics for online game winnings: Rule 135 points to the online net-winnings calculation in Section 194(1), Table Sl.No.5, and to withholding entries in Section 393(3), Table Sl.No.2.
Under the earlier 1961 Act, Section 115BBJ taxed net winnings from online games at 30% and Section 194BA set out tax deducted at source, or TDS, for earlier periods.
TDS means the payer deducts tax under the legal rules rather than leaving everything to the recipient.
The calculation is not a flat percentage of every withdrawal; prescribed rules account for factors such as deposits, withdrawals, and account balances. Individual circumstances still matter.
Paying tax does not make a prohibited game legal. A tax rule explains how income is treated; it does not grant permission to operate or participate in an otherwise prohibited service.
Frequently asked questions
Can I play online poker for real money in India?
India’s nationwide prohibition on online money games took effect on 1 May 2026 and covers games involving skill as well as chance. Do not assume that an older state license or foreign website makes real-money online poker permissible. News reports say petitions challenging the Act are before the Supreme Court; verify the latest official court record before relying on any current-status claim. The treatment of an individual user’s conduct requires a separate legal assessment.
Is poker a game of skill or gambling in India?
Poker involves both skill and chance, and historic case law does not settle every poker format. For online games involving monetary stakes, the 2025 Act applies regardless of the skill-versus-chance argument.
What if my state bans online poker?
Do not assume access through an app, another state, or an offshore website changes the legal position. State rules can introduce additional issues for other gambling activities. Check current official rules and seek qualified local legal advice for a specific situation.
Do I pay tax on poker winnings?
It depends on the tax year. For 2026-27, the Income-tax Act, 2025 and Rules, 2026 apply, including the new online net-winnings and withholding mechanics. Earlier tax years remain under the 1961 Act, which taxed online game net winnings at 30% under Section 115BBJ. The calculation follows prescribed rules, not a flat deduction from every transaction. Tax obligations do not establish that the underlying gaming activity is lawful.
